Terms of Use

These Website Terms of Use apply to visitors and users of the Klearmind Clinics website.

1. Introduction and acceptance

These Website Terms of Use govern access to and use of the website operated by Klearmind A Professional Medical Corporation, doing business as Klearmind Clinics. The website provides general information about Klearmind, its programs, and ways to contact or schedule with the clinic. By accessing or using the website, you acknowledge these terms. If you do not agree, do not use the website.

These terms apply only to the public website. Clinical services are governed by applicable law and by the treatment consent, financial policy, privacy notices, and other documents provided during the patient intake process. If these terms conflict with a signed patient document concerning clinical care, the patient document controls for that care.

2. General information only

Website content is provided for general educational and informational purposes. It is not medical advice, diagnosis, treatment, a prescription, or a substitute for consultation with a qualified healthcare professional. Do not start, stop, or change a medication or treatment based on website content.

Medical information changes over time. Although Klearmind may revise website content, it does not promise that every statement is complete, current, or applicable to a particular person.

3. No physician-patient relationship

Browsing the website, sending an email, requesting information, or scheduling an informational call does not by itself establish a physician-patient relationship with Klearmind or any clinician. A clinical relationship is established only through the clinic’s formal intake and consent process, when accepted by an authorized clinician in accordance with applicable law.

4. Emergencies and urgent concerns

The website, general email address, and scheduling tools are not monitored for emergencies and must not be used for urgent clinical concerns. Call 911 or go to the nearest emergency department for a medical emergency. Call or text 988 for a suicide or mental-health crisis in the United States. Current patients should use the communication instructions provided by the clinic for nonemergency clinical matters.

5. Eligibility and clinical decisions

Klearmind provides physician-directed services to eligible patients located in California. Availability shown on the website does not mean that a person qualifies for a particular treatment. Eligibility, diagnosis, treatment selection, prescribing, dosing, monitoring, and follow-up are determined individually by the treating physician after an appropriate evaluation.

No treatment result is promised or guaranteed. Individual responses, risks, side effects, and durability of benefit vary. Testimonials describe individual experiences and do not establish typical or guaranteed results.

6. Ketamine and compounded medications

Ketamine is approved by the U.S. Food and Drug Administration as an anesthetic. Its use for psychiatric and pain conditions is off-label. Compounded oral ketamine is not FDA-approved. When medically appropriate, Klearmind may prescribe patient-specific compounded medication, but Klearmind does not compound or dispense it. Medication is prepared and dispensed by an appropriately licensed compounding pharmacy pursuant to a valid prescription.

Other compounded medications described on the website are not FDA-approved, and the FDA does not review compounded medications for safety, effectiveness, or quality before marketing. A website description does not represent that any medication is appropriate or available for a particular person.

7. Images and illustrations

Unless expressly identified otherwise, photographs, illustrations, medication images, and other visual elements are generic or illustrative. They may not depict an actual Klearmind patient, clinician, facility, treatment, medication, device, or product. An image must not be used to identify a medication or make a treatment decision.

8. Scheduling and communications

Public scheduling tools may be used only for the appointment purpose described. An informational call is not a medical evaluation. Do not submit symptoms, diagnoses, medication lists, treatment histories, photographs, or other medical information through a public scheduling field, ordinary email, or general website communication.

Current and prospective patients must use CharmHealth or another channel specifically approved by Klearmind for individualized medical communications. Messages sent through third-party tools are also subject to the third party’s terms and privacy practices.

9. Privacy

Use of the website is subject to the Klearmind Website Privacy Policy. Klearmind’s handling of protected health information is described in its Notice of Privacy Practices. The Website Privacy Policy and Notice of Privacy Practices are separate documents and are incorporated here only by reference.

No internet transmission or electronic system can be guaranteed to be completely secure. Do not use the public website to transmit information that Klearmind has instructed you to submit through the patient portal or another approved secure method.

10. Minors

A person under 18 must use scheduling and patient-facing features through a parent or legal guardian unless the person is legally emancipated or applicable law permits otherwise. The website is not designed to allow a minor to independently consent to treatment. A parent or legal guardian is responsible for supervising a minor’s website use.

11. Prices, payments, cancellations, and refunds

Prices and program descriptions may change. A displayed price is not a guarantee of eligibility, coverage, or a particular treatment plan. Charges, deposits, cancellation fees, package terms, credits, and refunds are governed by the pricing information presented at purchase and the applicable Klearmind financial and cancellation policies. Klearmind does not promise insurance coverage or reimbursement unless expressly stated in writing for an authorized program.

12. Third-party services and links

The website may link to or use third-party scheduling, patient-portal, payment, map, video, pharmacy, laboratory, or government services. Klearmind does not control their availability, content, security, accessibility, or privacy practices, and a link does not imply endorsement. Third-party terms and notices apply.

13. Intellectual property and permitted use

The website and its original text, graphics, logos, design, and arrangement are owned by or licensed to Klearmind and protected by applicable law. Users receive only a limited, revocable, nonexclusive, nontransferable right to access the website for personal, lawful, noncommercial use.

Users may print or save a reasonable number of pages for personal reference. They may not reproduce, publish, modify, sell, license, frame, scrape, systematically download, or commercially exploit website content without prior written permission, except as permitted by law.

14. Prohibited conduct

Users must not:

  • Use the website for an unlawful, fraudulent, threatening, abusive, or infringing purpose.
  • Attempt to gain unauthorized access to the website, patient portal, accounts, servers, or connected systems.
  • Introduce malicious code, interfere with operation or security, test vulnerabilities without authorization, or evade access controls.
  • Impersonate another person or misrepresent an identity, affiliation, medical status, or authority to act for another person.
  • Use automated methods to collect content or personal information except as permitted by law and authorized in writing.
  • Submit another person’s confidential, medical, or identifying information without lawful authority.

15. Website availability and changes

Klearmind may update, suspend, restrict, or discontinue any website feature or content at any time. The clinic does not guarantee uninterrupted access, error-free operation, or continued availability of any page, program description, scheduling time, or third-party integration.

16. Website disclaimer

To the fullest extent permitted by law, the website and its content are provided on an as-is and as-available basis without warranties concerning availability, accuracy, completeness, merchantability, fitness for a particular purpose, or noninfringement. This disclaimer concerns the public website only. It does not limit duties applicable to clinical care, privacy, professional services, or rights that cannot lawfully be waived.

17. Limitation of website-related liability

To the fullest extent permitted by law, Klearmind and its personnel will not be liable for indirect, incidental, special, consequential, or punitive damages arising solely from use of, inability to use, or reliance on the public website or a third-party link. These terms do not limit liability for clinical negligence, malpractice, breach of privacy or security duties, fraud, willful misconduct, or liability that cannot lawfully be limited.

18. Governing law, severability, and no waiver

California law governs these terms to the extent permitted. If a provision is invalid or unenforceable, the remaining provisions remain effective and the affected provision will be enforced to the maximum lawful extent. Failure to enforce a provision is not a waiver. Separate patient agreements and applicable law may govern clinical-service disputes.

19. Changes to these terms

Klearmind may revise these terms as its website, services, or obligations change. The current version will display a revision or effective date. Continued use after publication acknowledges the revised terms to the extent permitted by law, but no update replaces a separate consent required for clinical care, privacy, or payment.

20. Contact information

Questions about these Website Terms of Use may be directed to Klearmind Clinics, Privacy Office, 1249 Pleasant Grove Blvd., Suite 100, Roseville, California 95678; telephone 916-900-6686; email info@klearmindclinics.com.
